These Terms of Service ("Terms") govern your access to and use of Paramodo Pro's cloud-based services — including account registration, license validation, subscription management, and any API calls made by the local plugin to Paramodo's serverless backend (collectively, the "Services"). These Terms do not govern the local SketchUp plugin software itself; that is addressed in our End User License Agreement (EULA).
By registering an account or using any part of the Services, you confirm that you have read, understood, and agreed to these Terms in full. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
"Provider" means the operator of Paramodo Pro, incorporated in British Columbia, Canada. "User" or "you" means any individual or entity accessing the Services. "Account" means the registered profile associated with your email address. "Subscription" means a paid monthly or annual plan granting access to Pro features. "Trial" means the fourteen (14) day complimentary Pro access period available to new users. "LemonSqueezy" means Lemon Squeezy, LLC, our authorized payment and licensing processor.
Paramodo Pro's cloud Services, hosted on AWS Lambda (serverless infrastructure), provide the following functions:
The Services do not process, store, or transmit your SketchUp model data, geometry, or design files. All parametric computation is performed locally on your machine by the plugin.
To access Services beyond the Starter (Free) Tier, you must register an Account by providing an accurate name and email address. Your email address serves as your unique identifier. You are responsible for maintaining the confidentiality of any credentials associated with your Account and for all activity that occurs under it. You must notify us immediately at support@paramodo.com if you suspect unauthorized access to your Account.
You may not register on behalf of another person without their consent, create multiple Accounts to circumvent Starter (Free) Tier limits, or provide false registration information. Violation of these requirements may result in immediate Account suspension.
Paramodo Pro is offered under the following access tiers:
All Subscription payments are processed by LemonSqueezy (Lemon Squeezy, LLC), our authorized merchant of record. By purchasing a Subscription, you also agree to LemonSqueezy's terms of service and privacy policy as published on their website. The Provider does not directly store your payment card information; all billing data is handled by LemonSqueezy.
Subscription fees are charged in the currency displayed at checkout and are exclusive of applicable taxes, which will be calculated and added by LemonSqueezy at time of purchase where required by law. You authorize LemonSqueezy to charge your payment method on a recurring basis for the plan you selected until you cancel.
Prices are subject to change. The Provider will give at least thirty (30) days' notice of price changes to active subscribers via email. Continued use of the Subscription after a price change takes effect constitutes acceptance of the new price.
You may cancel your Subscription at any time through your Account settings or by contacting support@paramodo.com. Cancellation takes effect at the end of the current billing cycle; you retain Pro access through that date. No partial refunds are issued for unused days within a billing cycle.
Refunds are not provided for Trial periods. For annual Subscriptions, refund requests submitted within seven (7) days of the initial purchase date will be evaluated on a case-by-case basis. LemonSqueezy, as merchant of record, administers the refund process in accordance with its own policies and applicable consumer protection law.
If applicable consumer protection law in your jurisdiction grants you mandatory withdrawal or cooling-off rights, those rights are not affected by this policy.
When you register or use the Services, we collect and store the following personal data:
We do not collect, store, or process your SketchUp model data, design files, or geometry. Optional diagnostic logs are created locally by the plugin only after you allow diagnostic logging. They are not sent to the Services automatically; they may be included only if you choose to submit a crash report or share logs for support.
We do not sell or rent your personal data to third parties. We may share data with sub-processors (including AWS and LemonSqueezy) strictly to deliver the Services. Data is stored on AWS infrastructure, which may be located in regions outside Canada. By using the Services, you consent to this processing. Anonymized or aggregated usage data may be used for product analytics and improvement.
You may request access to, correction of, or deletion of your personal data at any time by contacting support@paramodo.com. Deletion requests will be fulfilled within thirty (30) days, subject to any legal retention obligations.
If you are located in a jurisdiction with specific data protection laws (including the European Economic Area or the United Kingdom), additional rights and obligations may apply. Contact us for details.
You are responsible for the accuracy of information you provide and for complying with all applicable laws. You agree not to use the Services to:
All content, trademarks, brand assets, API designs, and documentation associated with the Services are the exclusive property of the Provider or its licensors, protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you. Unsolicited feedback you provide regarding the Services may be used by the Provider without any obligation or compensation to you.
The Services rely on the following third-party providers, each subject to their own independent terms:
The Provider will make commercially reasonable efforts to maintain Services availability but does not guarantee uninterrupted or error-free operation. Scheduled maintenance, infrastructure events, or circumstances beyond our control may cause temporary unavailability. We reserve the right to modify, suspend, or discontinue any feature of the Services with reasonable notice where practicable. In the event of a material discontinuation of a paid feature, affected subscribers will be notified at least thirty (30) days in advance.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. THE PROVIDER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. STATUTORY RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW REMAIN UNAFFECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER AND ITS DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE PROVIDER'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some provinces of Canada and other jurisdictions do not permit certain exclusions of implied warranties or limitations of liability. In such cases, the above limitations apply to the fullest extent permitted by law, and your mandatory statutory rights remain unaffected.
You agree to indemnify, defend, and hold harmless the Provider and its affiliates, directors, employees, and contractors from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.
The Provider reserves the right to update these Terms at any time. For material changes, we will provide notice via email to registered account holders or through an in-product notification at least fourteen (14) days before the changes take effect. Continued use of the Services after the effective date of revised Terms constitutes your acceptance. If you do not agree to updated Terms, you must stop using the Services and cancel any active Subscription before the effective date.
These Terms remain in effect while you maintain an Account or use the Services. The Provider may suspend or terminate your Account immediately for material breach of these Terms, fraudulent activity, or as required by law. Upon termination of your Account, your right to use paid Services ceases; access to the Starter (Free) Tier local plugin remains subject to the EULA. The Provider will not be liable to you or any third party for consequences of Account termination. Sections 9, 12, 13, 14, and 17 survive termination.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada. The United Nations Convention on Contracts for the International Sale of Goods does not apply. To the fullest extent permitted by law, each party waives any right to a jury trial.
The Software and Services may be subject to Canadian, U.S., and international export control laws and regulations. You agree not to access, export, or re-export the Services in violation of any applicable export control law, including to sanctioned countries or restricted parties.
These Terms, together with the EULA, constitute the entire agreement between you and the Provider regarding the Services. If any provision is found invalid or unenforceable, the remainder continues in full force. The Provider may assign these Terms without restriction; you may not assign your rights or obligations without the Provider's prior written consent. Neither party is liable for delays or failures caused by events beyond reasonable control (force majeure). No third-party beneficiaries are created by these Terms. Failure by the Provider to enforce any term does not constitute a waiver.
